FAB Events Inc. (“Corporation”)
As an event ticket purchaser, I acknowledge that my participation in the “Event” involves risk to me and others. I acknowledge that due to the option of purchasing tickets for multiple individuals at one time through the online ticket purchasing application system, I am hereby acting on behalf of all those that I have purchased tickets for. On behalf of all those that I have purchased tickets for, I voluntarily accept all such risks, both known and unknown, and any and all consequences which may arise from those risks.
In consideration of the “Corporation” allowing me to purchase tickets for the “Event” (the receipt and sufficiency of which is hereby acknowledged), I, on behalf of myself, my dependents, heirs, executors, successors, assigns and personal representatives, hereby waive any and all claims of any kind or nature which I may have against the “Corporation”, its subsidiaries and affiliates, Heritage Park, Bison Transport Inc., Data Communications Management, Fountain Tire, Big Star Lights, committee, additional volunteers, additional sponsors and supporters, media partners, logistics suppliers and other participants in the event and each of their respective officers, directors, shareholders, agents, employees, servants, volunteers and subsidiaries (collectively hereinafter referred to as the "Released Parties") arising directly or indirectly from my participation in the Event including any and all claims for personal injury, death, illness, property damage, property loss or economic loss, even where such claims result from the negligence of the “Corporation” or such Released Parties. I hereby undertake and agree that I will not bring any legal proceeding in any court or tribunal asserting any such claims against any of the “Corporation” or such “Released Parties”. I hereby agree to indemnify and hold the “Corporation” and such “Released Parties” harmless from any such claims.
I expressly acknowledge that my participation in the “Event”, by its very nature could, in some circumstances, be hazardous, dangerous and result in physical injury. I acknowledge that certain behaviors on my part could increase the risk associated with the “Event”, including my failure to use proper or adequate safety equipment and failing to exercise due care and attention. If I am injured, unwell or incapacitated during the “Event”, I voluntarily consent to the assessment and treatment by members of the Holiday In The Park or Heritage Park staff that will be onsite. Should additional medical treatment be required, the services of EMS would be provided.
The terms of this Acknowledgment, Waiver and Release are severable from one another, are governed by the laws of the Province of Alberta, and if any one or more of the terms are invalid, this shall not affect the validity of the other terms. Any litigation surrounding the “Corporation” shall be brought solely within the Province of Alberta and shall be within the exclusive jurisdiction of the Courts in the City of Calgary. I have read this Acknowledgment, Waiver and Release, I understand its terms, and I am purchasing tickets to the “event” voluntarily.
Media Consent - I give the “Corporation”, perpetual, irrevocable, transferable, sublicensable right to use all forms of recording and images of me (and those that I purchased tickets for) at the “Event”, which I have posted to my social media account and which tag the “Corporation”, or use the Event hashtags #**** (“Content”) in any manner determined by “Corporation” sole discretion, including but not limited to on websites and social media pages operated by “Corporation”. The Content may be cropped, altered, modified or combined with other materials. I agree I have no right to compensation, royalty or any other payment of any kind. I will make no claim against “Corporation”, and will release “Corporation” or any person acting on their behalf from any liability related to the use of my Content. Images of myself, family, dependant or others that are taken in the Santa Tent, may be uploaded to our photographers website link for the purpose of viewing images with Santa. A QR code will be provided to those that have their images taken with Santa during the “event”.
Promotions Consent - I consent to receive offers, promotions, contests, giveaways, and other information about products and services by email, text message and other electronic messaging from FAB Events Inc., Heritage Park and their respective subsidiaries, affiliates, business brands and marketing partners.
